The Economic State of Emergency as a Method of Conducting Trade Policy by Donald Trump in the Context of National and International Regulations

Abstract

Donald Trump’s rise to power took place under the slogan “America First” heralding a change in the way the United States conducts trade policy. This change is intended to stop the negative effects of globalisation by protecting the American economy. In the following article, authors attempt to describe the changes that Donald Trump has made in the conduct of American trade policy. First part reconstructs the genesis of the legal structures used by the administration of the president of the United States to conduct trade policy, with special emphasis on tariffs as an instrument of conducting trade policy. In the second part, authors analyse the actions that the presidential administration has taken on the international stage and attempt to describe the methods it has used. In the third part, the authors propose the concept of economic emergency as a theoretical framework for analysing Donald Trump’s political approach. The summary presents conclusions on the shape of president’s trade policy in the course of his second term, including the influence of the “America First” program on it.
